Welcome to Monolith Performance Ltd (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of our website at https://monolithperformance.uk (the “Site”) and any services we provide (the “Services”). By accessing or using the Site or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.
1. Definitions
“Client” means any individual or organisation that engages Monolith Performance to provide Services.
“Services” covers 3D printing, 3D scanning, and reverse engineering as described on our Site.
“Content” refers to text, images, videos, documents or other materials made available through the Site.
2. Acceptance of Terms
By using the Site or placing an order for Services, you confirm that you have read, understood and agree to be bound by these Terms.
We may update these Terms from time to time. The “Last updated” date above applies. Continued use after changes constitutes acceptance of the new Terms.
3. Services and Quotations
Quotations
All Services require an online request or file upload.
We provide quotes in writing (email or via the Site) and hold them valid for 30 days unless stated otherwise.
Scope of Work
Services include design review, material selection, production, post processing and delivery as detailed in the quotation.
Any additional work outside the quotation scope will incur extra charges, to be agreed in writing.
Lead Times
Typical turnaround for 3D printing: 2–10 working days.
3D scanning: 1–5 working days.
Reverse engineering: 7-20 working days.
Expedited (“rush”) services may be available at premium rates.
4. Client Obligations
You must provide accurate, complete project requirements, CAD/STL files and any reference drawings.
You warrant that you have all necessary rights (including IP rights) in any files or designs supplied to us.
You agree to respond promptly to queries or requests for approval to avoid delays.
5. Pricing and Payment
Prices are exclusive of VAT (where applicable) and shipping costs, both of which will be itemised on your invoice.
Payment Terms
Standard clients: 50% payment due before starting any service, second 50% before shipping.
New clients may require payment in advance or a deposit.
Late Payment
Overdue amounts may incur interest at 4% above the Bank of England base rate, compounded monthly.
6. Intellectual Property
All pre–existing IP remains with its original owner.
You grant us a licence to use your designs solely to provide the Services.
On completion and payment, we grant you ownership of the physical parts produced; any tooling, machine code or workflow remains our confidential property.
7. Confidentiality
We treat all Client data and designs as confidential.
We will not disclose your confidential information except to fulfil the Services, to our subcontractors under NDA, or as required by law.
8. Warranties and Liability
Our Warranty
We warrant that Services will be performed with reasonable care and skill in accordance with industry standards.
Exclusions
We do not warrant the suitability of parts for any particular purpose unless explicitly agreed in writing.
Limitation of Liability
Our total liability for any claim arising out of these Terms shall not exceed the total fees paid by you for the affected Services.
We are not liable for indirect, special or consequential losses, including lost profits or business interruption.
9. Cancellation and Returns
Order Cancellation
You may cancel an order that has already been submitted before any work has been done; thereafter cancellation may incur up to 100% of the quoted fee as compensation.
Returns & Defects
Inspect all received parts within 2 working days.
Report any defects in writing with clear evidence. We will, at our discretion, reprint, repair, or refund the defective parts.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
